Judge Trump finds a violation of military law by activating the National Guard in California

On Tuesday, a judge found that President Donald Trump acted illegally when he established the National Guard and published a handful of Marines to address riots and anti -immigration and customs protests in California.
Judge Charles Prayer said the statements he made during a three -day trial last month when he wondered whether the presidents had any restrictions on when they could use the army for local purposes.
“I return to the really worrying thing: What are the factors restricted to the use of this force?” Prayer asked during the trial.
Trump federally made 4,000 members of the National Guard in June to support the federal authorities in California while they were conducting immigration raids, despite the objections of the Democratic Governor Gavin New Roosom.

Prayer’s decision comes as most members of the National Guard have been demobilized. California lawyers said during the trial, though, that 300 of them remained, which they argued as “important.”
“This is definitely a large number of soldiers who are a violation of the comedian law,” the state lawyer said.
While the judge’s decision may have a small impact on the ground in California, it still can have an issue of effects worldwide, as Trump and Defense Minister Beit Higseth published members of the National Guard in Washington, DC, and threatens to do so in other blue cities to address the street crime. The Trump administration is likely to appeal the decision of the Brayer, which may lead to the American Appeals Court of the Ninth Circuit and until the Supreme Court, which weighs the use of the unconventional administration of the National Guard.

One of the witnesses during the trial, Major General Scott Sherman, who supervised the activity of the National Guard in California, witnessed that the soldiers were trained in how to stay in compliance with the Posse Comitaus Law, which Brayer said was evidence that he was related to the lawsuit. The Trump administration said the law does not apply to the case.

The judge’s decision comes after the American Court of Appeal for the ninth district arrested the emergency order that was issued in June, in which Trump and Hegsith ordered the control of the National Guard to Newsome.
The Court of Appeal found that the courts must be “very certain” for the president when reviewing the deployment of the National Guard. The Trump administration is likely to resume the decision of Prayer, which means that the ninth circle is likely to weigh that Trump’s use of the army in California.
