Google’s shareholder sued the company to ban Tiktok

Tan, who refused to say if he personally supports Tijook’s ban, believes the central issue is enforcement. “There is a federal law that Tiktok app should not be in your store, and I can see Tiktok located in the application store,” says about Google. “Congress passed the law, and was supported by the Supreme Court. It is not discussed.”

In his opinion, Google publicly ignores the law, and wants to understand the legal basis for this decision, as well as to what extent should the shareholders be concerned about Google’s possible responsibility. “I felt that I should join someone doing something,” says Tan.

Books and records

Tan has a history of using records of records and litigation to investigate and combat what is seen as injustice. In 2019, litigate A hotel in New Hampshire on charges of violating anti -discrimination laws by preventing reservations from adults under the age of 21. Tan says that he dropped the case after the hotel modified its policy.

In February, Tan applied public records to the US Department of Justice in search of copies of the messages sent by the Public Prosecutor Pam Bondi to companies such as Google and Apple advising them that they will not bear the responsibility for continuing to distribute Tiktok. After the Public Prosecutor’s Office claimed that he had no record records of Tan’s request, he took the Ministry of Justice to the court. (New York Times foot A similar lawsuit.) In the court file, the Ministry of Justice denied any violations.

In March, Tan requested minutes and materials from the Alphabet Board of Directors ’meetings related to the TIKTOK ban, including the same letter reported by the Public Prosecutor. Tan submitted his request under a law in Dilayer, where the alphabet is merged, allowing shareholders who act in “goodwill” to search “books and records” when investigating the suspect’s mismanagement. Through a series of exchanges between Alphabet and HIS lawyer, Tan learned that the company has about half of the relevant documents, but it will not be delivered unless this is requested by the court.

“The lecturer of the Board of Directors will appear whether the board of directors has discussed the risks associated with the availability of the Tiktok application through Google Play, and if so, whether we have evaluated the risks of responsibility,” Tan’s lawsuit was filed on Tuesday. “The lecturer of the Board of Directors will also appear whether the council is considering whether to make Tiktok available through Google Play is a positive violation of federal law.”

Companies that Violation of Tikhak’s ban By continuing to distribute the application, the application can face penalties of $ 5,000 per user. Tan’s lawsuit claims that Google should not rely on Trump’s executive and Bondi’s message alone to protect them from legal risks, and that the technology giant can bear the responsibility of a president in the future – or even by Trump, who is known to change his opinion frequently.

Gavril, a lawyer who represents Google, claims in one exchange with lawyers who represent Tan that “many planets must correspond to this default damage to become a fact. Some may argue that the concerned shareholder should wait for actual damage before applying to investigate how this happens.”
