House Speaker Mike Johnson says Biden’s pardon is ‘invalid’ after automatic report

House Speaker Mike Johnson, R-Los Angeles, has questioned the validity of former President Joe Biden’s pardon after the release of a high-level report by the House Oversight Committee.
“It sounds like a terrible narrative or something, but it’s true,” Johnson said in response to House GOP allegations that Biden’s inner circle conspired to hide signs of the former president’s mental decline.
“So the pardon, for example, pardoned categories of violent criminals and released them onto the streets, and he didn’t even know who they were. He didn’t even know what categories they were, it seems, let alone the individuals he pardoned.”
Johnson said the pardon was “invalid on its face.”

“I mean, I was a constitutional prosecutor. I would love to take this case,” he said.
The panel’s GOP majority released a 100-page report Tuesday morning detailing the findings of its months-long investigation into the Biden White House, specifically whether his inner circle covered up signs of mental decline in the former president, and whether that alleged cover-up extended to executive actions signed via stylus without Biden’s full awareness.
House Oversight Committee Chairman James Comer, R-Ky., questioned whether Biden had actually signed off on all of his executive actions when the stylus was used — in particular, the thousands of clemency orders he authorized during his term.

Coomer said Biden’s automatically authorized actions should be deemed “invalid” and called on the Department of Justice (DOJ) to review the matter.
When asked at his press conference about whether there was a legal way to invalidate Biden’s executive actions signed by autopen, Johnson indicated that he saw such an opportunity in relation to Biden’s pardon specifically.
“You cannot allow a president to take office and have unelected, unaccountable, faceless people making huge decisions for the country,” Johnson said.
But a Biden spokesman walked back the committee’s conclusions in a statement to Fox News Digital on Tuesday morning.
“This investigation into the baseless allegations has confirmed what has been clear from the beginning: President Biden made the decisions of his presidency. There was no conspiracy, there was no cover-up, and there was no wrongdoing. Republicans in Congress must stop focusing on political revenge and instead work to end the government shutdown,” the spokesperson said.
In an interview with New York Times In July, Biden confirmed that he “made every decision” alone.
